America's Cup champion Alinghi lose court battle
America's Cup champion Alinghi has lost out in its legal battle against the BMW Oracle rival sailing team.
The next race was postponed after BMW Oracle took legal action against Alinghi claiming they had chosen an illegitimate yacht club as challenger in the America's Cup, however, the New York State Supreme Court ruled BMW Oracle's Golden Gate Yacht club was Challenger of Record.
BMW Oracle Racing owner Larry Ellison claimed that the rules of the next America's Cup were unfairly slanted in Alinghi's favour.
Alinghi had chosen Spain's Club Nautico Espanol de Vela as Challenger of Record, which meant the club could set the rules, but Judge Herman J Cahn ruled it was not eligible to do so because it does not hold an annual regatta.
Alinghi owner Ernesto Bertarelli was disappointed with the decision by the judge and he said: "There will now be a thorough review of the judge's decision and an analysis of the various options offered."
BMW Oracle chief executive Russell Coutts said he wanted to get together with Alinghi as soon as possible to agree on the rules for the event.
