Kenyan-born athlete Bernard Lagat must decide
Bernard Lagat has until 1 December to decide whether to pursue his
action against the International Association of Athletics Federations
(IAAF).
A court rejected the Kenyan-born American's claim for loss of earnings
after he tested positive for the banned substance Erythropoietin (EPO)
in 2003.
Bernard Lagat missed that year's Paris World Championships but returned to action a month later after a negative B sample.
The IAAF argued that Bernard Lagat was not banned from racing but had agreed to withdraw.
The hearing in Cologne also supported the validity of Bernard Lagat's failed test.
Nick Davies, spokesman for the sport's world governing body,
said: "The IAAF confirms that the athlete (Bernard Lagat) was not
convicted of a doping violation under its rules arising from the sample
collected on 8 August 2003.
"But this is something we have been saying publicly since 2003.
"We are very happy with the verdict and expect the athlete to accept it as well."
Bernard Lagat won the bronze medal in the 1500m at the Sydney Olympics in 2000.
